Please read these Terms of Service ("Terms") carefully before using the TC Forestry website or engaging our tree and forestry services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you ("Client," "You") and TC Forestry ("Company," "We," "Us"). By requesting a quote, scheduling services, or otherwise engaging with TC Forestry, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Description of Services
TC Forestry provides professional tree and forestry services, including but not limited to:
- Tree Spacing
- Small Tree Removal
- Bush Removal
- Log Bucking
- Storm Cleanup
- Wildfire Fuels Removal and Assessment
All services will be performed with due care and in a professional manner, adhering to industry best practices.
3. Quotes and Estimates
- Free Quotes: TC Forestry offers free, no-obligation quotes for services. These quotes are based on the information provided by the client and an initial assessment of the work required.
- Estimates vs. Final Price: Quotes provided are estimates. The final price may vary if unforeseen conditions are encountered (e.g., hidden obstacles, extensive decay, additional work requested by the client) or if the scope of work changes. Any significant changes to the scope or price will be communicated to the client and agreed upon before proceeding.
- Validity: Quotes are typically valid for a specified period (e.g., 30 days) from the date of issuance.
4. Payment Terms
- Invoicing: Invoices will be issued upon completion of services, unless otherwise agreed upon for larger projects requiring progress payments.
- Payment Due Date: Payment is due upon receipt of the invoice, unless a different payment schedule has been explicitly agreed upon in writing.
- Late Payments: TC Forestry reserves the right to charge interest on overdue accounts at a rate of [e.g., 2% per month or the maximum allowed by law] and/or recover any collection costs incurred.
5. Client Responsibilities
The Client agrees to:
- Provide Accurate Information: Furnish accurate and complete information regarding the property, trees, and desired services.
- Ensure Access: Provide clear and safe access to the work area for our equipment and personnel.
- Clear Obstacles: Remove any personal items, vehicles, or other obstacles from the work area before our arrival.
- Disclose Hazards: Inform TC Forestry of any known hazards on the property, including underground utilities, septic systems, irrigation lines, or other buried objects, and overhead power lines not immediately visible.
- Permits: Obtain any necessary permits or approvals from relevant authorities (e.g., municipal, strata, utility companies) required for the tree work.
6. Cancellation Policy
- Client Cancellation: If the Client needs to cancel or reschedule a service, they must notify TC Forestry at least [e.g., 24-48] hours in advance. Cancellations made with less notice may be subject to a cancellation fee.
- Company Cancellation: TC Forestry reserves the right to cancel or reschedule services due to unforeseen circumstances, including but not limited to adverse weather conditions, equipment malfunction, or personnel unavailability. We will make every effort to provide reasonable notice in such cases.
7. Limitation of Liability
- Damage: While TC Forestry takes utmost care to prevent damage, we are not liable for damage to underground utilities, irrigation systems, unmarked property lines, or other hidden obstacles not disclosed by the client.
- Acts of Nature: TC Forestry is not responsible for damages caused by acts of nature (e.g., storms, high winds, ice) occurring after services are completed.
- Property Damage: In the event of property damage directly caused by TC Forestry's negligence during the performance of services, our liability will be limited to the cost of repair or replacement of the damaged item, or the value of the service, whichever is less.
- Consequential Damages: TC Forestry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law principles.
9. Changes to Terms
TC Forestry reserves the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on our website with a revised "Effective Date." Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.
